C.J. Spillman accused of rape in '13

Dallas Cowboys safety C.J. Spillman, who is currently under investigation for an alleged sexual assault in September in Texas, was accused of attempted rape in December 2013 in Santa Clara, California, while playing for the San Francisco 49ers, according to a report in the New York Daily News.

According to the report, a massage therapist accused Spillman of trying to rape her at her studio. Spillman told police the contact was consensual.

According to police reports reviewed by the newspaper, a woman in December 2013 told police in Santa Clara, California, that Spillman groped her and tried to rip her pants off after she gave him a sports massage at her studio. The accuser also alleged that he pinned her to the ground and tried to force her to perform oral sex.

Spillman vehemently denied the woman's account when interviewed by police a few days after the incident.

Spillman was never arrested or charged in the 2013 incident.

On Thursday, the 49ers released a statement saying the team was aware that police "made contact" with Spillman in the 2013 incident, but no further action was taken.

"The San Francisco 49ers are aware that the Santa Clara Police Department made contract with C.J. Spillman in December 2013 and that he was neither arrested nor charged," the team said in a statement.

Last month, police in Grapevine, Texas, said they are investigating an allegation that Spillman raped a different woman on Sept. 20 at the team hotel in suburban Dallas. Despite the allegation, Spillman remains with the team and was at Cowboys practice Wednesday. Police said Thursday their investigation continues.

When asked about the newest allegation, Cowboys coach Jason Garrett said Wednesday: "Yeah, no comment on anything where there hasn't been a charge or an arrest made. I'll leave it at that."
